In Canada, applications for leave and judicial review in Federal Court regarding immigration matters can be filed by individuals directly affected by decisions made by immigration authorities.

Any individual who has been directly affected by a decision of an immigration authority, such as Immigration, Refugees and Citizenship Canada (IRCC) or the Immigration and Refugee Board (IRB), can file an application for leave and judicial review in the Federal Court. This includes applicants for immigration benefits, refugee claimants, permanent residents, and individuals facing deportation or removal orders.

If the Refugee Appeal Division has rejected your appeal, you still have another chance to file an Appeal in the Federal Court of Canada. You can seek Judicial Review of the RAD decision in the Federal Court of Canada. Judicial Review involves asking a judge to review the decision making process of the Refugee Appeal Division to ensure that it followed the law and acted fairly.

If your Refugee Claim has been rejected with the Refugee Protection Division and your appeal has failed before the Refugee Appeal Division, contact Mr. Bhangu, immediately. You have the option and most importantly the right to appeal this decision to the Federal Court.

There are strict time limits involved. You only have 15-days to appeal your decision to the Federal Court of Canada and apply for Judicial Review.
